I have run a property website for 7 years now and have followed the big changes in the Spanish market with a personal and professional interest. The buyers are certainly a lot thinner on the ground now compared with 3 or 4 years ago, but they are there! So how should you set the price of your property? The first thing to do is to speak to local (and I mean local) agents, they know the market, they know what is selling and for what price. It is no good you telling them what you want if it is completely unrealistic. I know lots of agents that won't even take on a property now unless a sensible price is agreed. The frequent answer to that is "I've seen one similar to mine for x euros", but did it sell, probably not.

Look in many agents windows and you will see photos of villas that have obviously been on their books for years. From the agents point of view, why would their salesmen take potential buyers to see your property if it is overpriced, they want to earn commission, so they will concentrate on the best priced villas and apartments on their books. Check out prices on the internet as well, if you see something similar to yours contact the owner or agent and ask them how long it has been on the market. I always ignore printed price lists and brochures, they are usually out of date, plus the bargains are always sold before they get on there. Now once you have settled on a value, then visit all the local agents and get it on as many of their books as possible, but don't sign sole agent contracts. This brings me to another point, get plenty of keys cut, enough for a set for each agent. This is very important as salesmen may only have a couple of hours with a potential customer, they won't want to spend half that trying to get keys, they will take them to see the properties to which they already have the keys.

Agents fees certainly vary a great deal, but what does it matter how much they earn if they sell your property? In my experience the more expensive agents tend to sell more properties, but I'm sure that isn't always the case. To avoid this expense you should try to sell it your self, as long as you get a good solicitor it shouldn't be a problem and their fees shouldn't be more than a flat fee of a few hundred euros.

1) DO YOUR HOMEWORK!
It may sound easy but a lot of people going to Spain to buy a property don't actually know what they want!. Yes, we would all love that big cliff top villa with its own private pool, but if your budget is for a 2 bedroom apartment, just look at those. Its easy to get carried away by looking at properties way over our budget but don't. Set a budget with a small amount of leeway and stick to it!

2) WHERE DO YOU WANT TO BE?
Spain is a vast country and prices vary tremendously across the regions. Costa Del Sol is the most well known area but is generally the most expensive. Inland Murcia is a great place for a villa on a large plot which can be a lot cheaper. However don't fall into the trap of trying to get the biggest property for the cheapest price. You might get a villa inland in Murcia for the price of an apartment on the Costa Del Sol, but do you want a 30 minute drive to the beach? Will anybody rent it if you need some income?. Don't be tempted by the cheapest price. Buy in the area that suits your needs and get the best property you can for your budget.

3)FIND AN INDEPENDENT LAWYER
It might sound strange but many people will buy in Spain and don't use a lawyer. Although its perfectly possible to do this and many people have no problems at all - but what happens if it goes wrong? A lawyer will cost about 1% of the purchase price, not a lot for peace of mind. a list of trusted lawyers can be found at the Spanish Property Insight website. Make sure the lawyer is independent of the builder.

4)CURRENCY EXCHANGE
It might sound obvious but Spanish properties are sold in Euros. When you have converted the price to your currency remember it can fluctuate depending on the currency markets. Use a currency exchange company. Not only will you save money on transfers fees, you will also be able to get a fixed price for your currency so you know what you will need to pay, even if its not needed for many months. Fix your currency in advance and know the price you will be paying.

5)GET A BANK GUARANTEE
If you are buying a new build property demand a bank guarantee. This will protect your money should the property not get finished by the builder. They are free and are required by law. Don't let the builder tell you you don't need it or you have to pay. It's your right - demand it!

6)BLACK MONEY
Black money or "B" money as it's known in Spain is when they buyer gives some cash to the seller and a lower price is declared on the deed. You will save a little bit of tax on the price, but when you sell you will have to pay Capital Gains tax on the difference of that lower price and your selling price unless you can find someone to give you cash. However the authorities are wise to this now and even if they just think you did this the penalties can be hefty. Don't do it and walk away from a seller who will only sell if you give black money.

7)HABITATION LICENSE
Any property new or resale should have a habitation license. It confirms that the property has received its final inspection and is in accordance with the town hall. Without it you cannot get connected to the water and electricity supplies and will be on temporary supplies until then. If it's a new build property demand your lawyer has this from the builder. If it's resale make sure the previous owners provide it. No habitation license - walk away

8)DON'T GO IT ALONE
Buying in Spain can be very simple. There is lots of help out there - but who can you trust?. Ask your friends who they bought with, check out forums and message boards, get your lawyer to run a check on the builders and agents. The most important thing is don't go it alone. It's common in Spain, you meet someone in a bar, he sounds like he speaks a bit of Spanish, he is from your country and his friend is selling a place - what luck! "He won't rip me off will he?" Well, we have heard many horror stories this way including people selling property they don't even own! Build trust with someone before committing to buy.

9)DON'T LET THE SUN GO TO YOUR BRAIN
There you are in Spain. It's hot and sunny and you have enjoyed a hearty lunch with some sangria. Every property will look beautiful. Swimming pools, lush gardens, tropical flowers - just the perfect place for your new home. But is it?. Make sure you compile a list of essential requirements. How many bedrooms you must have... distance to the beach... price...location... how close are the shops. Narrow down your search before you start looking and stick to your guns. Only buy the property if it fits your requirements. It might sound silly but - sun, sangria and property searching are not a good mix!

10)LEARN THE LANGUAGE
If you are going to buy a property in Spain you will be surprised just how much happier you will be even with a little Spanish. What happens if you need to make a phone call?, speak to a doctor?, pay your water bill?. You will find the Spanish very helpful if you can show you are making an effort in THEIR country. Owning a property in Spain - either as a holiday home or for full time living - has been an aspiration for many Europeans in the last twenty years, with Germany and the UK providing the most buyers.

But Spain's property market has hit some turbulence recently, with the Costa del Sol dropping from the favourite area to buy to least popular in just two years, leaving hundreds of thousands of holiday home owners vulnerable to a sharp drop in prices this year.

The Costa del Sol has been particularly hard hit as different negative factors came into play at around the same time - 'land grab' - where developers take land from existing owners with little recompense, world market jitters, and local corruption.

Another complication has hit the property market on the popular holiday island of Majorca. Plans have been put forward for more developments, and the local populations has successfully organised mass protest against development plans which they think will destroy much of the island's culture and heritage.

Majorca's economic base featured farming, livestock and agriculture before the 1960s. Before it became dependent upon tourism, Mallorca prided itself on being able to take care of itself without outside influence. The rising climate has made it hard to farm or raise livestock on the island. Limited water supplies make it difficult to maintain any kind of crop. The sparse amount of agriculture that is still done in Majorca is in an effort to keep up with the demand from tourists, and more development could spell disaster for the traditional way of life.

According to the 2005 census, the population of the city of Palma was 375,048. The population of the entire area was estimated to be 517,285; the 12th-largest urban area of Spain. Approximately half of the total population of Majorca lives in Palma, and it is feared that more developments will see Majorca turned into a concrete jungle.

Majorca started to develop as a holidays hot spot in the 1920's. Today, Majorca sees more than six million visitors each year, yet ninety-five percent of tourists concentrate in only five percent of its territory. Less developed areas of this elegant island are ripe for new development and prime property commands a great premium. It seems more people than ever before want to live on or invest in the island after taking their holidays in Majorca - but locals fear a doubling or trebling of the full time population in just a few years, placing a strain on the island's hospitals, schools and infrastructure, and vow to fight development plans.

A United Nations report highlights problems for both the Costa del Sol and Majorca, showing that local authorities are over dependent on new properties being built, with some city halls receiving over a quarter of their income from property related activity - a figure only sustainable by allowing more and more new developments, which eventually run contary to the wishes of the local populations.

The report says that there has been 'uncontrolled speculation for the last twenty years' and contributes to a poor housing situation for Spain's domestic market, with many developers preferring to concentrate on holiday villas and apartments to providing good standard housing for local people.

And it's local people in different regions of Spain who might change the way the property market works in the future, more for themselves than for outsiders.

The report says that the hardest hit sections of society in the Spanish property market are the young and the elderly, women, gypsies and the disabled - and as Mallorca has seen people are pushing housing policy higher up the political agenda.

The UN report also says that some fifteen per cent of Spain's apartments lie empty, even after discounting overseas owners.

'The amount of housing that isn't occupied might look alarming', comments a Mallorca internet site, 'But this isn't unusual. The same could be said of London, or among the Mediterranean countries Malta for example.'

Real estate developers in Spain and the Spanish islands face an uncertain 2008, as new developments are scrutinised more before being given planning consent, and an economic downturn threatens to drop the number of new buyers from Germany and the United Kingdom.

For those who don't already know, there are properties in Spain without the proper planning permission.

They have been in the news for the past few years and these illegal builds, can with little notice, be bulldozed with as little as 48 hours notice; traumatic as you can imagine.

How can this happen in a civilized society?

First and foremost people take risks. There are two specific areas during the purchase that identify a weakness. A poor solicitor, who deliberately turns a blind eye to suspect planning applications; and advice from a solicitor to a prospective buyer, who then themselves choose to carry on with the build regardless of potential problems.

The fraudulent Spanish lawyer cum solicitor, who surprisingly uses the language barrier as one reason for any errors, and the other reasons base themselves around communication errors with planning authorities.

In my attempt to defend Spain and their procedures, allow me to draw a comparison. If we compare with the UK as a parallel, then we can find there are fraudulent solicitors trading in the UK and several go to court for their actions.

Journalists enjoy a meaty story, something that will not only be a good story in the newspapers and television, but eventually bringing the said criminals to justice. That is all well and good for journalists... but why don't they study the fraudulent actions of solicitors more often? The simple reason is the legal profession has plenty of clout to deter any nosey journalist. So any invasion comes with a threat of legal action and subsequent lawsuit should they get any small aspect of their reporting wrong. So... unless the legal profession themselves have cast a certain individual aside; the ranks close... and delving into a solicitors affairs is rarely successful.

Yet the same closed ranks do not occur in Spain, as law-suits between countries are more difficult to pursue.

Allow me to clear up one aspect of the illegal builds in Spain. New builds can be illegal unless they have the proper documentation; properties built before the year 2000 are less likely affected.

Using that theory therefore, 'resale' properties are a better alternative to buy.

Those bulldozed illegal properties are generally in the 'campo' areas. These are the areas on the outskirts of small villages and towns.

The temptation to buy such properties, are clearly obvious as they are substantial in description with a good deal of land and physically built property upon the plot. What money may buy a three-bedroom apartment on the coast, would buy a 3 bedroom villa 5 miles inland, with a swimming pool and landscaped garden. Such temptation is on every individual intending to buy overseas property.

So here are the two main areas that property buyers need to be aware of.

Firstly, the so-called dodgy solicitor... These are obviously unscrupulous and similar to the dodgy people in the UK. They seem to settle in one area for a few years; do their dirty work and as their working environment begins to get tough, they move up and down the coast.

An option to overcome this possibility is to get another solicitor to follow their tracks. Tell your original solicitor that this is going to happen; and see whether he shakes in his boots. The cost maybe and extra £100, but the extra security and confidence you'll get through 'double-checking' will makes the buying process so much more comfortable.

The second possibility is the more frequent...

The system of authority for building is different here in Spain. In the UK for example, planning permission is sought from the local council; once approved everything is fine. Here in Spain they have a two-tier system. More often than not the local council will approve development; if only for no other reason than injecting funds back from central government, as population quota improves the Spanish councils grants.

The other tier within the system is the 'Regional Province' authorities, they have the last authority on planning. To ease the friction between the two, the Regional Authorities have designated areas that have urban development rights; allowing development. Without this right of development, more scrutiny and approval is needed.

Under this scrutiny comes 'delays' and doubt. Here the solicitor will advise a client that a previous application was approved by the local council, and then subsequently approved by the 'Regional Authority'. The decision to build as a consequence is put back onto the prospective buyer of the land; as the approval may take up and over a year.

Big Risk!... But the prospective buyer is so eager that they approve the purchase of land. With this approval comes the risk of everything going belly up and the house demolished.

As with some houses, that have the risk of being bulldozed, the owner at the time try's to sell the property. More often than not as explained earlier the property is substantial, beautiful and close to all amenities; so the likelihood of potential buyers is huge.

Again, in theory the property should never sell, as the solicitor does the necessary checks. But invariably the estate agent initiating the sale; knows of an unscrupulous solicitor who will scurry through the proceedings.

Downright scandal... but wherever there are people, there will be one dodgy character willing to earn a quick buck off someone. This scenario applies to any community it the world.

At this moment in time 95% of property are fine; a further 3% have no plans finalized but will get approval eventually; and the remaining 2% need further clarification before you consider purchasing.

My conclusion on Spanish Property... Not too much different to the 'builder's bodge jobs' cunningly hidden before the property is sold in the UK. Unscrupulous activity happens everywhere, wherever there are people, there will be two or three in every hundred that should raise suspicions. When buying check thoroughly and perhaps get a second solicitor checking over the final drafts.

Considering Moving or Buying Property on The Costa Blanca? by Mark Eastwood

I am writing this article from the point of view of someone who is maybe considering moving to the Costa Blanca or at least buying a property here and I will give you some things to consider and places I recommend.
The first thing to point out is the great difference between the northern Costa Blanca and the southern Costa Blanca. Starting in the south we have a very hot climate, the terrain on the coast is very flat. The sandy beaches are excellent in quality.

Going north the terrain starts to change, you start to see more mountains only just inland and hills start to appear, once you get past Benidorm all of a sudden you see green everywhere where before it was dry and barren.

This is why many people like the northern Costa Blanca. It reminds them of the green northern European country from where they came. Certainly the beaches are not as nice but they are still sandy and of good quality. In this area you will find cliffs, coves and some rocky beaches.

The southern Costa Blanca tends to have coastal towns that very much centre around the beach, so you have many high rise apartment blocks just off the beach area. In the northern Costa Blanca towns spread further inland and tend to have scores of villas littering the pretty green hillsides. Inland you have green valleys full of orange groves and vineyards full of bustling little villages and towns.

While the northern Costa Blanca is prettier and more scenic it is however much more expensive and it is much further to the airports. My advice would be this: if you just want a second home for a getaway, consider the southern Costa Blanca. It is built up therefore there are loads of restaurants and bars within walking distance. The beaches are superb and most importantly, either Murcia airport or Alicante airport will be practically on your doorstep, so you only need to get a taxi which eliminates the expense of car hire.

Now if you are considering moving to the Costa Blanca full-time I would suggest looking to the northern Costa Blanca. Look to live from Benidorm upwards. Inland towns such as La Nucia or the Jalon Valley or the coastal towns of Calpe, Moraira, Javea or Denia are popular choices.

Much also depends on your age. If you are retired then it is irrelevant but if you need to work then this must come into the equation. Living in some remote village may be ok to begin with but most probably you would be better off living in a large town which has a large expat population (unless of course your Spanish is excellent).

Alicante is the biggest city on the Costa Blanca but is very Spanish. Looking south then you start to get large expat populations in the area of Torrevieja and surrounding towns. In essence this area is one big housing estate gradually joining together as one. There are few Spanish compared to the vast numbers of northern Europeans. English is widely spoken. This means that there is great scope for providing services to expats and many job opportunities also.

Looking north of Alicante then I would suggest Benidorm where there are plenty of bars and restaurants as it is the biggest tourist resort on the whole of the Costa Blanca. Obviously work is going to be more seasonal as not so many expats live there all year round, Benidorm is virtually all high-rise apartment blocks catering to tourists.

Further north and towns such as Alfaz del Pi, Altea, Calpe, Moraira, Javea and Denia all have very large expat populations which provide great opportunities to live and work in Spain.

There is no doubt that the Costa Blanca is a great place to live with a fantastic all-year-round lifestyle. However the Costa Blanca is a huge area of Spain and as such it has tremendous differences between towns. The decision to move to the Costa Blanca or buy a holiday home here is a big one, no doubt about it.

Perhaps my best tip is the one I have saved until last, try before you buy, in other words rent first. Get a long-term let if you can and then once you are here sampling the life and exploring the different areas of the Costa Blanca, you can find the area that most suits you.
